{"id":154428,"date":"2021-03-26T01:10:21","date_gmt":"2021-03-25T19:40:21","guid":{"rendered":"https:\/\/arunachaltimes.in\/?p=154428"},"modified":"2021-03-26T01:10:21","modified_gmt":"2021-03-25T19:40:21","slug":"sc-quashes-fir-lodged-against-journo-patricia-mukhim-over-fb-post","status":"publish","type":"post","link":"https:\/\/arunachaltimes.in\/index.php\/2021\/03\/26\/sc-quashes-fir-lodged-against-journo-patricia-mukhim-over-fb-post\/","title":{"rendered":"SC quashes FIR lodged against journo Patricia Mukhim over FB post"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>NEW DELHI, 25 Mar:<\/strong> The Supreme Court on Thursday quashed an FIR lodged against journalist Patricia Mukhim for allegedly creating communal disharmony through her Facebook post.<\/p>\n<p style=\"text-align: justify;\">A bench headed by Justice L Nageswara Rao allowed the plea filed by Mukhim against the Meghalaya High Court order which had refused to quash the FIR against her.<\/p>\n<p style=\"text-align: justify;\">&#8220;We have allowed the appeal,&#8221; the bench said while pronouncing the judgment.<\/p>\n<p style=\"text-align: justify;\">The top court had reserved its verdict in the matter on 16 February.<\/p>\n<p style=\"text-align: justify;\">Mukhim&#8217;s counsel had earlier argued before the apex court that there was no intention to create<\/p>\n<p style=\"text-align: justify;\">disharmony or conflict through the post which referred to an incident of a murderous assault on 3 July, 2020.<\/p>\n<p style=\"text-align: justify;\">The counsel for the Meghalaya government had earlier claimed in the top court that a &#8220;communal colour&#8221; was given to the scuffle between minor boys and her post showed that it was a communal incident between tribal and non-tribal people.<\/p>\n<p style=\"text-align: justify;\">On 10 November last year, a single judge bench of the Meghalaya High Court had refused to quash the FIR filed by the Lawsohtun Dorbar Shnong (a traditional institution).<\/p>\n<p style=\"text-align: justify;\">Mukhim had hit out at the Lawsohtun village dorbar (council) on Facebook for failing to identify the &#8220;murderous elements&#8221; after five boys were attacked at a basketball court in July this year.<\/p>\n<p style=\"text-align: justify;\">Eleven people were picked up and two were arrested in the case.<\/p>\n<p style=\"text-align: justify;\">The police complaint was filed against Mukhim by the village council on 6 July last year for her post on social media, alleging that her statement incited communal tension and might instigate communal conflict.<\/p>\n<p style=\"text-align: justify;\">She was subsequently booked under Section 153 A (promoting enmity between different groups on grounds of religion, race, residence, language, etc) and other provisions of the Indian Penal Code.
