{"id":230446,"date":"2023-12-12T01:42:00","date_gmt":"2023-12-11T20:12:00","guid":{"rendered":"https:\/\/arunachaltimes.in\/?p=230446"},"modified":"2023-12-12T01:42:00","modified_gmt":"2023-12-11T20:12:00","slug":"sc-upholds-abrogation-of-article-370","status":"publish","type":"post","link":"https:\/\/arunachaltimes.in\/index.php\/2023\/12\/12\/sc-upholds-abrogation-of-article-370\/","title":{"rendered":"SC upholds abrogation of Article 370"},"content":{"rendered":"<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>NEW DELHI, 11 Dec:<\/strong> The Supreme Court on Monday upheld the government&#8217;s decision to abrogate Article 370, which bestowed special status on the erstwhile state of Jammu &amp; Kashmir, and said that steps should be taken to conduct elections in the assembly by 30 September next year.<\/p>\n<p style=\"text-align: justify;\">Writing the judgment for himself and Justices Gavai and Surya Kant, Chief Justice of India (CJI) DY Chandrachud said that Article 370 of the Constitution was a temporary provision and the president has the power to revoke it.<\/p>\n<p style=\"text-align: justify;\">\u00a0The apex court also upheld the validity of the decision to carve out the union territory of Ladakh from Jammu &amp; Kashmir in August 2019.<\/p>\n<p style=\"text-align: justify;\">The erstwhile state of Jammu &amp; Kashmir does not have internal sovereignty different from other states of the country, he said.<\/p>\n<p style=\"text-align: justify;\">&#8220;&#8230; all provisions of the Indian Constitution can be applied to J&amp;K,&#8221; the CJI said.<\/p>\n<p style=\"text-align: justify;\">&#8220;We hold the exercise of presidential power to issue constitutional order abrogating Article 370 of Constitution as valid,&#8221; the CJI said.<\/p>\n<p style=\"text-align: justify;\">Jammu &amp; Kashmir became an integral part of India and this is evident from Articles 1 and 370, he said while pronouncing the judgment.<\/p>\n<p style=\"text-align: justify;\">&#8220;The constituent assembly of J&amp;K was never intended to be permanent body,&#8221; the CJI stated.<\/p>\n<p style=\"text-align: justify;\">Article 370, which was abrogated on 5 August, 2019, was an interim arrangement due to war conditions in the erstwhile state, Justice Chandrachud said.<\/p>\n<p style=\"text-align: justify;\">The princely state had become an integral part of India and this is evident from Articles 1 and 370, the CJI said.<\/p>\n<p style=\"text-align: justify;\">The bench, comprising CJI DY Chandrachud and Justices Gavai, Surya Kant, Sanjay Kishan Kaul and Sanjiv Khanna, assembled at 10:56 am to pronounce the three separate and concurring judgments.<\/p>\n<p style=\"text-align: justify;\">Justices Kaul and Khanna wrote their judgments separately.<\/p>\n<p style=\"text-align: justify;\">The apex court reserved its verdict in the matter on 5 September after a 16-day hearing on a batch of petitions challenging the abrogation of the provisions of Article 370.<\/p>\n<p style=\"text-align: justify;\">The pronouncement of the verdict by the CJI is underway.
