{"id":260646,"date":"2025-03-18T01:35:10","date_gmt":"2025-03-17T20:05:10","guid":{"rendered":"https:\/\/arunachaltimes.in\/?p=260646"},"modified":"2025-03-18T01:35:10","modified_gmt":"2025-03-17T20:05:10","slug":"sc-gives-3-months-to-centre-for-delimitation-exercise-in-ne","status":"publish","type":"post","link":"https:\/\/arunachaltimes.in\/index.php\/2025\/03\/18\/sc-gives-3-months-to-centre-for-delimitation-exercise-in-ne\/","title":{"rendered":"SC gives 3 months to Centre for delimitation exercise in NE"},"content":{"rendered":"<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>NEW DELHI, 17 Mar:<\/strong> The Supreme Court on Monday granted three months to the Centre for carrying out the delimitation exercise in Arunachal Pradesh, Nagaland, Manipur and Assam.<\/p>\n<p style=\"text-align: justify;\">A bench headed by Chief Justice Sanjiv Khanna noted the request of Centre&#8217;s Solicitor General Tushar Mehta, who sought some more time.<\/p>\n<p style=\"text-align: justify;\">The bench then deferred the hearing to 21 July and asked the Centre to do the needful within three months.<\/p>\n<p style=\"text-align: justify;\">The top court had previously raised concerns over the delay in carrying out the delimitation exercise in these states despite a 2020 presidential order rescinding the deferment of the process.<\/p>\n<p style=\"text-align: justify;\">&#8220;Once the president rescinds the notification, that is enough to proceed with the delimitation exercise. Where does the government come in?&#8221; the bench asked as it told the Centre&#8217;s counsel to seek instructions.<\/p>\n<p style=\"text-align: justify;\">The Centre said that while consultations areunderway for Arunachal and Nagaland, the ongoing violence in Manipur has made the situation unconducive.<\/p>\n<p style=\"text-align: justify;\">The bench was hearing a plea filed by the Delimitation Demand Committee for the State of Arunachal Pradesh, Assam, Manipur &amp; Nagaland in North East India.<\/p>\n<p style=\"text-align: justify;\">The plea sought immediate implementation of the delimitation exercise in these states.<\/p>\n<p style=\"text-align: justify;\">Advocate G Gangmei, representing the petitioner, had said that the president&#8217;s 2020 order made the exercise legally mandatory.<\/p>\n<p style=\"text-align: justify;\">He said that two years have passed since the writ petition was filed, but no concrete steps have been taken to initiate delimitation in Arunachal, Nagaland, and Manipur.<\/p>\n<p style=\"text-align: justify;\">Assam alone saw progress, with delimitation completed in August 2023 following an order from the Law and Justice Ministry, Gangmei added.<\/p>\n<p style=\"text-align: justify;\">The Election Commission of India maintained that specific directions from the central government arerequired to begin delimitation under Section 8A of the Representation of the People Act, 1950.<\/p>\n<p style=\"text-align: justify;\">The petition cited the presidential order of 28 February, 2020, which allowed delimitation in the four northeastern states, along with the union territory of Jammu and Kashmir.<\/p>\n<p style=\"text-align: justify;\">It alleged selective denial of delimitation in these states, claiming violation of the fundamental right to equality under Article 14 of the Constitution.<\/p>\n<p style=\"text-align: justify;\">The plea highlighted that despite decades of elections being conducted peacefully in these states, no delimitation has taken place since the amendment of the Delimitation Act in 2002.<\/p>\n<p style=\"text-align: justify;\">The lack of action has left the northeastern states at a disadvantage compared to the rest of the country, it added.
