ITANAGAR, May 16: The Gauhati High Court (HC) Itanagar Permanent Bench has directed the government respondents, particularly the Papum Pare Deputy Commissioner to consider and dispose of the representation submitted by the petitioners on 6 October, 2016 relating to firing range site of the 10th ITBP, Kimin within a period of one month.
With this direction, the instant Writ Petition stands disposed of.
Hearing a WP (Civil) 199 (AP) 2018, filed by petitioner Takam Epak and another one on 2 May, 2018, the court of Justice Ajit Borthakur further said
“keeping in consideration of the submissions of the learned counsels of both sides and perusal of the documents, more particularly, the order, dated 19.01.2016, passed in PIL 16 (AP) 2014 and further, the contentions made in the representation dated 06.10.2016, submitted by the petitioners to the respondent no 3 (Papum Pare DC), the court is of the view that the matter needs to be considered by the authority concerned in accordance with law.”
The petitioners have prayed for a direction to the respondent authorities, more particularly respondent No 3 to consider their objection-cum-representation within a specified time period and not to release compensation amount for land acquisition for establishment of firing range site of 10th ITBP, Kimin.
They further contended that without considering the representation, the respondent authorities have carried out the acquisition process and at the stage of disbursement of the compensation amount to the land owners.
