YUPIA, Aug 11: The west sessions division judge’s court here on Friday gave its decision on a nearly 12-year-old murder case and held the accused, Biri Taling, “guilty and convicted under Section 3012/201 IPC” for the murder of one Subash Jeram in September 2006 and causing “the evidence of the commission of the offence to disappear”.
In an order issued on 10 August, 2018, the sessions judge awarded “life imprisonment instead of death sentence for the offence under Section 302 IPC and minimum imprisonment for the offence under section 201 IPC.”
The court sentenced Taling to “undergo imprisonment for life and to pay a fine of Rs 5,000 only, in default of payment of fine to undergo further rigorous imprisonment for six months for the offence punishable under Section 30-2 IPC. Also sentence to undergo simple imprisonment of three years and to pay a fine of Rs 1,000 only, in default of payment of fine to undergo further simple imprisonment for one month for the offence punishable under Section 201 IPC. The sentence shall run concurrently,” the order read.
On the night of 17 September, 2006, Biri attacked Jeram with a dao (machete) at the Dikrong bridge in Doimukh. The victim was taken by the accused to the then general hospital in Naharlagun. However, Jeram succumbed to his injuries the very next day.
