I am writing to express my deep concern over the increasing number of modified bike silencers on the roads of East Siang district, particularly in Pasighat. These modified silencers are not only illegal but also create excessive noise pollution, disturbing the peace and tranquility of the area, especially during night hours.
As you are aware, noise pollution is a serious issue that affects the health and wellbeing of the public. According to Section 268 of the Indian Penal Code (IPC), ‘public nuisance’ is an offence, and Section 290 IPC prescribes punishment for the same. Additionally, the Motor Vehicles Act, 1988, and the Central Motor Vehicles Rules, 1989, prohibit the use of vehicles with modified silencers that exceed the permissible noise limits.
Specifically, Section 194 (abatement of noise) of the Motor Vehicles Act, 1988, states that whoever drives a motor vehicle which produces sound exceeding the prescribed limit shall be punishable with a fine which may extend to Rs 1,000 for the first offence and Rs 2,000 for the second or subsequent offence.
I request the East Siang police to take immediate action against those modifying and using these illegal silencers under the relevant sections of the IPC and the Motor Vehicles Act. It’s the responsibility of the authorities to ensure that the laws are enforced, and the public is protected from such nuisance.
I hope your newspaper will highlight this issue, and the authorities will take necessary action to curb this menace.
