JD(U) candidate seeks rejection of rival candidates’ nomination

ITANAGAR, Mar 29: The Janata Dal (United)’s Tali assembly constituency MLA candidate, Jikke Tako, has written to the state chief electoral officer (CEO) here, seeking rejection of the nomination papers of BJP candidate Thaji Gichik Kiogi and INC candidate Dayum Yara “by suo moto action against the decision of the constituency’s returning officer.”
In a representation to the CEO, Tako on Thursday claimed that “the nomination papers of both Thaji Gichik Kiogi and Dayum Yara did not comply with the established law and violated the mandatory requirement of Form 26, Rule 4A, Serial No 5, Para 2&3, which is a clear case of violation of Supreme Court of India judgment order Civil Appeal No 7178 of 2001, dated 2nd May, 2002 (Union of India vs Association for Democratic Reforms and others).
“The returning officer willfully not applied above mandatory rule and thereby, nomination papers of the two candidates were not rejected during the scrutiny,” Tako said.
He requested the CEO to reject the nomination papers of the two candidates and declare him (Tako) elected unopposed.
JD(U) general secretary Ashfaque Ahmad Khan has also written to the Election Commission of India, claiming that the nomination papers of Kiogi and Yara had been “arbitrarily accepted” despite Tako’s objection, and requested to the CEO to review the decision of the returning officer.
