Why is complete segregation of tainted and non-tainted candidate so important? And when is null and void required?

A genuine aspirant who reaches the viva voce by dint of sheer hard work only and not by buying any question paper, even if they stand last in the queue in the waiting list, is more deserving than candidates who bought question papers and against whom the government, investigation agencies, or the court cannot take any action, even though they were named by Posi Gamlin and Taket Jerang.

If tomorrow nothing happens in this fiasco and the accused go scot free, it will be the highest level of injustice done to the genuinely aggrieved candidates. This is where the demand for complete segregation of tainted and non-tainted officers is most important, so that not a single genuine aspirant faces injustice.

But if it becomes impossible to segregate tainted and non-tainted officers then reconducting the exam with proper arrangement becomes crucial. I’m no legal expert, but in such cases, many high court and SC verdicts are there where they quashed the entire recruitment process even after many years when they found some irregularities in the process which could not be undone.

Yes, it’s important to see if it can be rectified or not, considering the veracity of the irregularities. In fact, it’s the very crux of the judgment involving multiple victims, with contradicting natures of justice. A bench of SC Justices DY Chandrachud and MR Shah also observed that, if recruitment for public employment stand vitiated as a consequence of systemic fraud or irregularities, the entire process would become illegitimate and be a strong reason to cancel the examination.

Meanwhile, in some corner, ignoring all such grievances, the AAPSU is more concerned about the officers who are not certain about each other’s genuineness, and is showing no interest in aspirants who are genuinely aggrieved by the commission.

At this point, the AAPSU needs to reconsider its stand. It must at least consider various points, like the way the investigation is going on, the court proceedings, the government’s responses, the officers’ behaviour, and all. After considering all the points, it should’ve put forward an amicable solution, clearing all the doubts by the aggrieved aspirants, at least.

But no, it is totally against null and void, without any alternative.

Anyhow, in the end we all hope to see truth and justice prevail.
