Union seeks reappointment of sacked casual staffer

ITANAGAR, Jun 18: Alleging that the Pakke-Kessang ADC misused his official power by terminating the service of one Limo Loya, a casual driver, “on extraneous pretext,” the Joint Working Committee of the Arunachal Pradesh Trade Unions (JWCAPTU) has urged the authorities concerned to reengage Loya in his previous post at the earliest.
In a representation to the chief secretary, the JWCAPTU stated that Loya had been appointed as an ALC under the establishment of the Pakke-Kessang DC, and had been engaged as a contingency driver.
It claimed that the ADC terminated the driver’s service on 1 June without affording him any opportunity of being heard.
“A show cause notice is warranted to enable him to explain the indictment. Yet his service was terminated. The action of the ADC is in total contravention of the principle of natural justice, whereby he has been condemned unheard and the constitutional protection provided under article 311 (2) of the constitution of India, which mended that an enquiry and opportunity to be heard is required before an employee, whether temporarily or contractual is removed from his post,” the JWCAPTU stated.
It also demanded that the chief secretary initiate disciplinary proceeding against the ADC for “exploiting an employee,” and sought reengagement of Loya in his previous post on or before 6 July, failing which, it said, it would resort to tools-down strike and phase-wise democratic action.
